Streetil Terms of Service

1. Acceptance of Terms

Welcome to Streetil. By accessing or using the Streetil website, mobile application, or any other platform offered by Streetil (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

Streetil reserves the right, at its sole discretion, to modify or replace these Terms at any time.

2. Streetil's Role as a Marketplace

Streetil operates exclusively as a technology platform connecting customers ("Users") with independent third-party local merchants ("Merchants") for the sale, service, or rental of goods.

Platform Only: Streetil is NOT a vendor, seller, or service provider of any product listed on the Platform. The contract for the sale, fulfillment, delivery, and quality of goods/services is exclusively between the User and the Merchant.

Liability: Streetil is not responsible for the quality, safety, legality, or fulfillment of any item or service purchased from a Merchant.

3. User Obligations

By using the Platform, you agree to:

1. Account Security: Maintain the confidentiality of your account information and be responsible for all activities that occur under your account.

2. Accurate Information: Provide accurate and current information when placing orders or registering for an account.

3. Lawful Use: Use the Platform only for lawful purposes and in accordance with these Terms.

4. Merchant Policies: Abide by the specific policies (including refund, return, and cancellation policies) established by the individual Merchant from whom you purchase.

4. Merchant Responsibilities

Merchants operating on the Streetil Platform are subject to a separate Merchant Agreement. Merchants are solely responsible for:

1. The accuracy of their listings, pricing, and availability.

2. The fulfillment, quality, and delivery of all items and services sold.

3. Handling all customer service, cancellations, returns, and refunds related to their transactions, as detailed in their own policies.

5. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Streetil or its content suppliers and is protected by intellectual property laws.

User Content: By posting or submitting content (e.g., reviews) to the Platform, you grant Streetil a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Platform.

6. Disclaimers and Limitation of Liability

A. Disclaimer of Warranties

The Platform is provided on an "as-is" and "as-available" basis. Streetil makes no warranties, expressed or implied, regarding the operation of the Platform or the information, content, or materials included. Streetil expressly disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

B. Limitation of Liability

To the fullest extent permitted by law, Streetil, its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of profits, data, or goodwill) arising out of or in connection with your access to or use of, or inability to access or use, the Platform or any products/services purchased through it.

7. Indemnification

You agree to indemnify and hold harmless Streetil and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your improper use of the Platform, or your violation of any law or the rights of a third party.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Streetil is incorporated, without regard to its conflict of law provisions.
